POSH Compliance FAQs
Is POSH compliance mandatory for my company?
Yes, if you have 10 or more employees at a workplace you must constitute an Internal Committee. The Act protects all women at the workplace, and every employer has duties under it regardless of size.
Who should be on the Internal Committee?
A senior woman employee as presiding officer, at least two employees committed to the cause of women or with legal or social work experience, and one external member from an NGO or a person familiar with sexual harassment issues. At least half the members must be women.
How often should POSH training happen?
We recommend training for all employees at least once a year, at induction for new joiners, and separate capacity-building for Internal Committee members.
Can you be the external member on our Internal Committee?
We can support you in appointing a suitable, qualified external member. Contact us to discuss your requirement.
What happens if we don’t comply?
The Act provides for penalties for non-compliance, and repeated violations can lead to higher penalties and cancellation of licences or registrations. Non-compliance also creates serious legal and reputational risk.
